These terms are an agreement between you and Prose Counsel. By creating an account or using Prose Counsel, you agree to them.
Prose Counsel is software for people handling a court case without a lawyer, in any U.S. court and case type. It is not a law firm and is not a lawyer, and it does not give legal advice. It is not a substitute for the advice of an attorney. Using it does not create an attorney-client relationship. It is operated by an individual, not a law firm.
Prose Counsel offers case setup, deadlines, case file storage, steps and worksheets, official forms and a form wizard that fills official PDFs from your own answers on your device, hearing scripts, and Check before you file (checks run on your device; a citation lookup sends only the citation text to an outside legal research service). Paid plans add case search and buying court records (through a partner court-records service, plus PACER fees, with a copy kept in your own case files), more than one case, and “Counsel,” an AI assistant that answers questions about your case and drafts documents into your drafts or correspondence folders. A free Student plan includes “Coach,” an AI guide that helps a student do their own work and never does it for them, limited to 40 questions a day.
Counsel and Coach are AI. They can be wrong, including about law, deadlines and citations. Everything they produce is a draft. You must check it, decide what to do, and sign and file it yourself. Anything Counsel could not verify is tagged [VERIFY]; missing facts are tagged [FILL].
Chats with Counsel or Coach, and the files you store, are not protected by attorney-client privilege, because no lawyer is involved. Courts have split on whether work product protection applies to this kind of material. You should assume that anything you type could be requested in a lawsuit.
You must be 13 or older to use Prose Counsel. If you are 13 to 17, you may use only the Basic plan and the Student plan (no paid plans, no Counsel), and you should use it with a parent’s or guardian’s permission. Paid plans and Counsel are for adults 18 and older. We ask for your birth month and year once to check your age. For an adult, we keep only that you are an adult; if you are under 18, we keep the month you turn 18 until then, as the Privacy Policy explains. If someone says they are under 13, or we learn that someone under 13 has an account, we close it and delete their information.
In federal court, and in many state courts, a corporation, LLC, partnership or other business entity may appear only through a licensed lawyer (Rowland v. California Men’s Colony, 506 U.S. 194 (1993)). Prose Counsel is for people representing themselves, not for businesses appearing without a lawyer.
Plans are Basic (free), Plus, Pro, Elite, and a free Student plan for verified students. Today, no payment is taken in the app: you ask for a plan in Settings and an admin sets it. You can move to a lower plan, or to Basic, yourself in Settings at any time; it starts at once, your cases and files stay, and you can go back to the plan the admin set. Paid plans that include court records include up to 10 a month, and buying them can be paused for everyone if the service’s own monthly limit is reached. If we start charging for a plan, we will show the price, what renews and when, and how to cancel, before you pay anything; we will get your clear agreement first, and you will be able to cancel online as easily as you signed up.
Your content stays yours. By using Prose Counsel, you give us only the permission we need to store and process your content in order to run the service for you (for example, saving your files, and sending your questions and documents to the service providers described in the Privacy Policy so Counsel or Coach can answer). We do not claim ownership of anything you create or upload.
We may suspend or close an account that breaks these terms or the law. You may stop using Prose Counsel at any time, and you can delete your account yourself in Settings (Delete your account), which deletes your case files and everything else we keep about you, as the Privacy Policy describes. Download anything you want to keep first.
To the fullest extent the law allows, Prose Counsel is provided “as is” and “as available,” without warranties of any kind, whether stated or implied, including any implied warranty that it will work correctly, be fit for a particular purpose, or be uninterrupted or error-free. Nothing in Prose Counsel is a guarantee that a filing will be accepted, that a deadline is correctly stated, or that a citation is accurate. You use it at your own risk and remain responsible for verifying anything it produces before you rely on it.
To the fullest extent the law allows, we will not be liable for indirect, incidental, special or consequential damages, or for lost data, lost filings, missed deadlines, or any outcome of your case, arising from your use of Prose Counsel, even if we were told this could happen.
Nothing in this section limits any right or protection that the law does not allow us to limit.
If we change these terms in a way that matters, we will show the change in the app and ask you to agree again before you can keep using Prose Counsel.
